Dietitians: PAIA + POPIA Check
We often focus our energy on clinical outcomes, patient resources, and consultation flows. But there is a “behind-the-scenes” side to private practice that is equally vital: legal compliance.
If you are a dietitian practicing as a sole proprietor, a partnership, or a private company in South Africa, this is a friendly but important nudge: Is your practice compliant?
The Basics: PAIA vs. POPIA
While the acronyms are often used together, they serve different functions in protecting your practice and your patients.
PAIA (Promotion of Access to Information Act)
PAIA gives patients and third parties the right to request access to information held by your practice. To comply, you must have a PAIA manual—a document that outlines exactly what information you keep and the process through which that information can be accessed.
POPIA (Protection of Personal Information Act)
POPIA focuses on the “how.” It governs how you collect, store, use, and protect your patients’ sensitive data, including medical history, lab results, and contact details. In simple terms: PAIA provides access, while POPIA provides protection.
What You Need to Do (And When)
Legal compliance isn’t just about avoiding penalties; it’s about building a foundation of trust with your patients and ensuring your practice is legally sound. Your action items are:
- Ensure you have an updated PAIA manual.
- Align your internal systems with POPIA (review how you store clinical notes and digital communications).
- Submit your PAIA manual to the Information Regulator before the 30 June 2026 deadline.
