5.1. This template is provided on an “as is” and “voetstoots” basis, and Just4Dietitians (Pty) Ltd has provided no warranties, expressly, impliedly or tacitly, regarding its accuracy, suitability or fitness for a particular person or patient. You acknowledge that you will be using the template at your own and exclusive risk. 

5.2. Take note that each individual patient’s care is depended on a variety of factors, and a proper professional evaluation and dietetic treatment plan formulated for each specific patient’s use to ensure optimal results.

No business relationship between Just4Dietitians (Pty) Ltd and your clients will arise, and you hereby indemnify Just4Dietitians (Pty) Ltd and its agents and employees against any claim of whatever nature by any client serviced by you as supplier as provided for in the Consumer Protection Act 68 of 2008, or otherwise.

You confirm that no direct marketing was relevant in relation to the marketing of this product or the conclusion of any agreement in relation thereto, nor will any direct marketing be relevant between Just4Dietitians (Pty) Ltd and any of its agents or employees in relation to your patients or clients.

Just4Dietitians (Pty) Ltd and its agents or employees will not be liable in relation to any claim of any party either in terms of the common law or any statutory enactment for payment of any damages including but not limited to direct, indirect, incidental, consequential and/or punitive damages arising from the use or misuse of the template.

The specific terms and conditions highlighted herein, has been provided in a conspicuous manner and form that has attracted your attention prior to entering into agreement with Just4Dietitians (Pty) Ltd or, engaging in activities associated herewith or, gaining access to the facility or, the expected consideration for use of the facility. You declare yourself fully acquainted with the content, substance and effect of the terms and conditions set out herein, which you agree to constitute necessary, fair and reasonable terms in relation to the relevant facility.

It is agreed that the interpretation hereof will be subject to the laws of South Africa inclusive of the common law and any statutory enactment or amendment thereof.

You agree to the jurisdiction of the Magistrate’s Court with jurisdiction as set out in terms of section 28 of the Magistrate’s Court Act 32 of 1944 as amended with regard to any dispute that may arise in consequence hereof, irrespective of the amount in dispute or the value in consideration.

You confirm that no representations other than may be set out herein have been made either expressly, tacitly or impliedly by Just4Dietitians (Pty) Ltd or any of its agents or employees.

All intellectual and related proprietary rights in relation to the template or access to the facility, including those associated with the format, appearance, usefulness, trading names, trademarks, logos, copyright or personal materials, professional opinion, composition, knowledge and acumen will remain the exclusive property of Just4Dietitians (Pty) Ltd. Should the agreement or access to the template or facility be terminated by Just4Dietitians (Pty) Ltd, you agree that the template and all information associated therewith are to remain the personal and exclusive property of Just4Dietitians (Pty) Ltd

The format, layout and appearance of the template and the facility, are confidential in nature and you agree to be bound to such confidentiality in favour of Just4Dietitians (Pty) Ltd during the tenure of the agreement, and thereafter.

Just4Dietitians (Pty) Ltd reserves the right to amend the terms and conditions hereof or to terminate access to the template at any time and without prior notice should reasonable grounds exist therefore.

In the event of breach by you of one or more of this terms and conditions Just4Dietitians (Pty) Ltd will be entitled to seek appropriate relief inclusive but not limited to proceed with an application for an interdict. Should Just4Dietitians (Pty) Ltd proceed with any legal action of whatever nature against you due to breach of one or more of this terms and conditions, Just4Dietitians (Pty) Ltd will be entitled to payment of their legal costs on the scale as between attorney-and-client.
